Product Guarantees —Our products are perishable and therefore we only guarantee that our product will reach you in the freshest possible way. It is the client’s responsibility to read product descriptions & allergen information. The client remains responsible to advise us on any specific food intolerances and/or allergies the client would like to us to cater for as indicated hereunder in the Food Intolerances section.

 

Disclaimer of liability — The website owner shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company’s personal information or material and information transmitted over our system. Severability — Any provision of any relevant terms and conditions, policies and notices, which is or becomes unenforceable in any jurisdiction, whether due to being void, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as void and the remaining provisions of any relevant terms and conditions, policies and notices shall remain in full force and effect.

 

Applicable laws (choice of venue and forum)—Use of this website shall in all respects be governed by the laws of the state of Malta regardless of the laws that might be applicable under principles of conflicts of law. The parties agree that the courts located in Malta, shall have exclusive jurisdiction over all controversies arising under this agreement and agree that venue is proper in those courts.

 

Deliveries & Delivery charges — All orders with a value of €50 and over will not incur a delivery charge. For orders under €50, a delivery charge exclusive of VAT, variable depending on the delivery address, will be added to your order .  Deliveries/Pick Up dates for online orders are chosen from the calendar at checkout stage and require a 2 day lead time. Elia Borg Bonaci Ltd reserves the right to refuse deliveries/pick ups for particular dates. We will get in touch on the delivery date to confirm that our delivery person is enroute. On the day of delivery, Elia Borg Bonaci Ltd shall not be held responsible for any delays due to traffic, or any other unforeseen circumstances, beyond their control.

 

Cancellation Policy – In the event of a cancellation of an online order, written notice must be sent via email on [email protected] at least 5 (five) working days prior the delivery/collection date and a credit note with the full amount will be issued.

 

Credit notes/Vouchers – Any credit notes or vouchers issued by Elia Borg Bonaci Ltd, are non-transferable and cannot be exchanged for cash value. If the total amount is not utilized, the remaining amount will not be given in cash value. Credit notes/vouchers are not valid beyond their expiry date. If the credit note/voucher cannot be redeemed by the stipulated date, the client is to ask for an extension by sending an email on [email protected] at least 5 working days from the date of expiration. Elia Borg Bonaci Ltd reserves the right not to extend vouchers/credit notes claimed after their expiration date. Elia Borg Bonaci Ltd reserves the right to cancel any credit notes or vouchers which have been transferred without authorisation.

 

Complaints— You are kindly requested to send any complaints via email on [email protected] including photographic proof of product defects, date and location of purchase. Complaints will not be considered if products have been consumed or photographic proof is not provided.

 

Returns Policy — If a product has been delivered not as expected and needs to be returned to our bakery, please get in touch by calling our team on +356 2124 6920 by not later than 1 hour (one) after delivery has been completed.  To return items collected from Elia Café in Hamrun, kindly refer to Pick-Ups section.

 

Refund Policy – Unless agreed otherwise, no refunds will be issued. It remains at the sole discretion of Elia Borg Bonaci Ltd to provide refunds.

 

Product Imagery – All product photos shown on the website are for illustration purposes only. Final product when delivered may vary from that shown in the photo.

 

Party Items & Set — Menus are set with a minimum order quantity of 10. Elia Borg Bonaci Ltd reserves the right to adjust the quantity or increase the minimum quantity of other products without prior notice.

 

Online Orders – Payment for online orders are to be settled in full prior to confirming the order.

 

Indicated prices for products & delivery service (where applicable) are exclusive of VAT. VAT will be added upon checkout. All pricing may be reviewed and adjusted by Elia Borg Bonaci Ltd from time to time without prior notice.

 

Pick Ups — Client is to present a printed or a digital copy of the order confirmation to our Shop managers. It is the Client’s sole responsibility to check the order for any shortages and/or damages before leaving the premises.

 

Shipping outside the Maltese Islands — We currently only deliver to localities in Malta. For orders delivered to Gozo, you are kindly requested to contact our offices for instructions.

 

 

Brochures

  • Prices & Menus indicated on Brochures issued by Elia Borg Bonaci Ltd are indicative and are subject to change.

 

  • Menus can be built ad hoc, and other items can be removed or introduced.

 

  • Elia Borg Bonaci Ltd reserves the right to change certain items from the chosen menu in case of unavailability or seasonal limitations, or excessive price increases as a result of inflation or external economic factors which are beyond the control of the company. Any changes shall be discussed and agreed to with the client before the Event. The service charge may increase in the event of excessive inflation or due to external economic factors which are beyond the control of the company.

 

Inhouse & Outside catering

Terms & Conditions – General                       

Price will vary according to changes in Menu .

Total price includes 18% Vat.

Menu is a sample menu and hence can be customised to your liking.

Quotes shall remain valid for two months from date of issue. Prices may change if the date of the event is changed.

Staff Overtime                       

Staff are paid for up to 6 hours on the premises unless indicated otherwise

After 6 hours on the premises, each staff member is paid an extra €12 + vat per hour.

Any catering staff overtime shall be charged until all the staff has left the premises.

 

Conditions for Catering                     

We shall not be responsible in any way for any food left over after the event. The client shall remain solely responsible for any consumption of such food after the event.

No food, sweets or other edible items other than those supplied by Elia Borg Bonaci Ltdmay be served at the reception.

For a stand up reception the menu must be confirmed at least 15 days before the date of the Event. The number of guests is to be confirmed up to 7 days before the date of the Event.

Final billing will be according to the agreed number of guests, confirmed up to 7 days before the Event.

Logistical charges may apply for events not catered for at our venues.

 

Food Intolerances                 

Kindly inform us in advance if any of the guests suffer from any food allergies or intolerances. All foods prepared by Elia Borg Bonaci Ltd are prepared in a factory that handles all allergenic ingredients, therefore cross-contamination may be possible during the handling and serving of foods.

Elia Borg Bonaci Ltd shall not be held responsible or liable for any possible traces of allergens that might be present during the handling or serving of food.

 

Deposits & Cancellations for Catering Including Staff and Services           

Bookings are secured against a deposit of 30% of the contracted services.

A further 50% of the remaining balance is to be settled 15 days prior to the event date.

The outstanding balance is to be settled within 7 days from the reception date.

All deposits paid according to the above schedule are non-refundable.

It shall remain at the sole discretion of Elia Borg Bonaci Ltd to allow any date or events changes against such deposit.

Any cancellations shall be notified in writing at least 7 days before the Event. Cancellations made less than 7 days before the event date will result in the client becoming liable to pay the remaining balance due based on the agreed number of guests.

 

Deposits & Cancellations for Catering (without staff & services)               

Bookings are secured against a deposit of 30% of the contracted services.

The final & outstanding balance is to be settled upon collection / delivery.

All deposits paid according to the above schedule are non-refundable.

It shall remain at the sole discretion of Elia Borg Bonaci Ltd to allow any date or events changes against such deposits.

Any cancellations shall be notified in writing at least 7 days before the Event. Cancellations made less than 7 days before the event date will result in the client becoming liable to pay the remaining balance due based on the agreed number of guests.
